Tree knowledge — owners’ duties and safety in Hong Kong
In Hong Kong, managing trees on private land is the owner’s responsibility. Proper care protects your property, neighbours, and the public, and helps you avoid legal liability.
Tree owners’ duties under Hong Kong law
Owners of private lots owe a common-lawduty of careand must maintain trees on the land so they do not endanger people or property.
If negligence leads to a tree failure causing injury or property damage, the owner may be liable (Occupiers Liability Ordinance, Cap. 314).
Many government-granted leases includetree preservation clauses — written consent from the Lands Department is required before removal or major pruning.
Routine minor pruning (such as removing small dead twigs) usually needs no application.
Emergencies: if a tree poses animmediate dangerto the public, a qualified arborist may act first after assessment, but a detailed report (including replanting proposals) must be submitted to the Lands Department within 21 days.
Recommendation: arrange a professional tree risk assessment before typhoon season each year (around April–May). The Development Bureau’s Tree Management Handbook is the official guide and is strongly recommended.
Hazard signs — when do you need a professional?
Not every tree needs to be felled, but contact a qualified arborist promptly if you see the following:
Branches extending over buildings, roads, or overhead lines
Dead, hanging, or weak branches
Cracks, cavities, or decay in the trunk or main limbs
A leaning tree or an unbalanced crown
Fungal growth, mushrooms, or mycelial fans (brown root rot is common in Hong Kong)
Sparse foliage, deadwood, or discolouration
Exposed or damaged roots, or heaving soil
